What’s Changing

Workplaces are operating in a bit of a middle ground. Hiring has slowed, but expectations have not. AI is being used, but not always clearly understood. Flexibility is expected, but not always consistently managed.

Where Risk Is Showing Up

Across organizations, we are seeing the same patterns emerge. Managers are making on the spot discipline decisions without documentation. Similar employee issues are being handled differently across teams. Terminations are being rushed to solve immediate problems. Employee concerns are sometimes addressed informally instead of through a consistent process. At the same time, AI tools are being used in day to day work without clear guidance.

For example, we recently saw a situation where two employees engaged in similar conduct but were disciplined differently by two managers. The intent was not unfairness, but without consistency or documentation, that difference became the focus of the complaint.

In another case, a manager addressed an employee concern “in the moment” but never documented or followed a formal process. Weeks later, when the issue resurfaced, there was no clear record of what had been done or why.

Individually, these moments may not seem significant. Collectively, they create patterns that are easy to question and difficult to defend.

Why It Matters

The hard truth is that most claims are not built on one bad decision. They are built on a series of inconsistent ones. When leaders handle situations differently, even with good intent, it can create

the perception of unfairness. When documentation is missing, it becomes difficult to tell a clear and credible story.

AI is also introducing new risk in subtle ways. As a starting point, leaders should be clear on what AI can be used for, what decisions require human review, and what information should never be entered into external tools, especially confidential or employee specific data.

Right now, organizations are navigating a fast moving environment where expectations have evolved, but systems have not always caught up. Compliance today is less about policies on paper and more about how those policies show up in real decisions.

That is where leadership makes the difference.

Where to Start

The good news is that the solution is not complex. It starts with slowing down just enough to be intentional. Document key decisions before acting. Align leaders on how performance and discipline should be handled so employees are treated consistently. Put simple guardrails around AI use. Use a structured approach to complaints, even when they seem minor.
